1. Who we are

1.1 These Terms of Service ("Terms") govern the sale and supply of the "11 Risks" report (the "Report") through the website 11risks.com (the "Website").

1.2 The seller and trader is Filip Molčan, founder of 11 Houses and 11 Risks. ("we," "us," "our"). Contact e-mail: hi@filipmolcan.com. "11 Risks" and "11 Houses" are product and brand names of this sole trader.

1.3 By placing an order you ("you," the "Customer") agree to these Terms. These Terms are provided in English and the contract is concluded in English.

2. Definitions

2.1 "Report" - the location due diligence document (delivered as a PDF and, where offered, a markdown file) that we prepare for a specific property location you submit.

2.2 "Consumer" - a natural person acting outside the scope of their business or profession.

2.3 "Location" - the address, parcel, settlement or municipality you submit for screening.

2.4 "Public Data" - publicly available datasets and sources, including EU sources (for example EFFIS wildfire data, EEA and Copernicus datasets, Eurostat, and the European Seismic Hazard Model ESHM20), national registries, and public news archives.

3. What the Report is

3.1 The Report is a location screening for informational purposes only. It assesses the Location - not the building - across 11 risk categories in three pillars: (A) natural and climate hazards, (B) security and resilience, and (C) local viability, using exclusively Public Data.

3.2 Each category is rated on three separate dimensions: Risk (green / amber / red / unrated), Evidence confidence (high / medium / low), and Coverage (complete / partial / none). The Report states the location precision reached (parcel / address / settlement / municipality) and the snapshot dates of the sources used. The Report never produces a single overall score.

3.3 The Report is prepared on a best-effort basis. Where we could not verify something, the Report says so plainly.

4. What the Report is NOT

4.1 The Report is not professional, legal, technical, financial, investment, insurance, tax or valuation advice, and it is not a recommendation to buy, not to buy, or to pay any particular price for any property.

4.2 The Report is not a survey, inspection, or assessment of the building. It is not a structural survey, not a building-condition or building-legality assessment, not a valuation, and not a title or legal-ownership verification.

4.3 The Report is not a prediction or forecast of any future event. Hazard screening describes modelled or measured exposure of a Location to categories of hazard. It cannot and does not predict whether, when, or with what severity any earthquake, flood, wildfire, storm, or other event will occur or affect any property.

4.4 The following are expressly out of scope: legal title verification; building legality; structural condition of the property; valuation; parcel-level surface-water (pluvial) flood verdicts where no authoritative mapping exists; neighbourhood-level crime data where not officially published; confirmation of insurability or insurance premiums; and anything requiring authenticated or paid registry access.

4.5 The Report does not replace a lawyer, notary, surveyor, structural engineer, valuer, tax adviser, insurer, or title check. You should obtain such professional services independently before making any purchase decision.

5. Data sources and limitations

5.1 The Report is built from Public Data produced by third parties. We do not control and cannot guarantee the accuracy, completeness, timeliness, or availability of Public Data. Public Data is used "as is."

5.2 Findings are modelled and/or measured and inherit the resolution, methodology, assumptions, and update cycle of their sources. A finding can never be more precise than the underlying data. The Report states the resolution and snapshot date of each source so you can judge this yourself.

5.3 Absence of a finding is not proof of absence of risk. A "green" or "no material findings" rating for a category means that, within the Public Data available at the stated resolution and snapshot dates, we identified no material indication of that risk. It does not mean the risk does not exist, cannot exist, or will not materialise. Data gaps, unmapped hazards, and events not captured by public sources may exist.

5.4 Where coverage is stated as "partial" or "none," or evidence confidence is "low," the relevant limitation is stated in the Report and you should treat that category accordingly.

6. AI-assisted production

6.1 The Report is partially produced using artificial-intelligence tools and is then reviewed by a human who holds editorial responsibility for the delivered Report. We disclose this in the interest of transparency.

6.2 AI assistance is used to help compile, summarise, and draft content from Public Data. It does not remove the limitations described in Sections 4 and 5, and it does not turn the Report into professional advice.

7. Ordering, price and payment

7.1 You order by submitting a Location and completing checkout on the Website. The contract is concluded when we confirm your order and payment.

7.2 Prices are shown on the Website and at checkout and include all applicable taxes unless stated otherwise. The total price is shown before you place a binding order.

7.3 Payment is processed by Stripe. By paying you also accept Stripe's applicable terms. We do not store your full card details; card processing is handled by Stripe as payment processor.

8. Delivery

8.1 The Report is delivered electronically (download link and/or e-mail attachment) to the address you provide, normally within 48 hours of payment confirmation. Because each Report is made to order for your specific Location, some Reports may take longer; if so, we will tell you.

8.2 It is your responsibility to provide a correct e-mail address and to ensure you can receive the Report.

9. Right of withdrawal and its waiver (Consumers)

9.1 As a Consumer you normally have the right to withdraw from a distance contract within 14 days without giving a reason.

9.2 Because the Report is digital content supplied electronically and is made to order for your specific Location, you lose the right of withdrawal once we begin preparing and supplying the Report, provided you have expressly consented to this and acknowledged the loss of the withdrawal right. At checkout you must actively confirm, before payment: "I request that preparation and supply of my Report begin immediately, before the 14-day withdrawal period expires, and I acknowledge that by giving this consent I lose my right to withdraw from the contract once supply has begun." We will confirm this consent to you in text form.

9.3 If you do not give the consent described in 9.2, we will not begin work until the 14-day period expires or until you separately confirm. In that case you may withdraw within 14 days by any clear statement sent to hi@filipmolcan.com.

9.4 If we have not begun supply, or if the consent in 9.2 was not validly obtained, your 14-day right of withdrawal remains and we will refund you in full.

10. Conformity and complaints

10.1 We are liable to Consumers for the Report conforming to the contract as required by Czech law and EU rules on digital content. If the Report does not conform to its description in these Terms and on the Website (for example, it is not supplied at all, or does not match Sections 3-6), you are entitled to the statutory remedies: to have it brought into conformity, a proportionate price reduction, or termination of the contract, as applicable.

10.2 To make a complaint, e-mail hi@filipmolcan.com with the Location, your order reference, and a description of the defect. We handle complaints without undue delay and, for Consumers, within 30 days unless a longer period is agreed.

10.3 Nothing in these Terms limits or excludes your statutory rights arising from defective performance or conformity. Those rights cannot be waived.

11. Refund policy

11.1 Pre-delivery baseline refund: if we cannot reach at least settlement-level precision or a good-faith data baseline for your Location, we refund your payment in full and do not deliver a Report.

11.2 Withdrawal refunds: where a valid right of withdrawal applies (Section 9), we refund in full within 14 days of your withdrawal, using the same payment method you used.

11.3 Statutory remedies: where the Report is defective or non-conforming (Section 10), you receive the applicable statutory remedy, which may include a refund.

11.4 Outside 11.1-11.3, a Report supplied after your valid waiver of the withdrawal right (Section 9.2) is not refundable merely because you disagree with its findings or because a hazard later materialises - subject always to your non-waivable statutory rights.

12. Licence and intellectual property

12.1 We retain all intellectual-property rights in the Report, the Website, the methodology, and the "11 Risks" and "11 Houses" branding.

12.2 On full payment we grant you a non-exclusive, non-transferable licence to use the Report for your own personal, non-commercial purposes in connection with the specific Location, including sharing it with your own professional advisers for that transaction.

12.3 You may not resell, republish, redistribute, sublicense, or make the Report publicly available, and you may not remove disclaimers or notices from it, without our prior written consent.

13. Prohibited uses

13.1 You must not use the Report or the Website unlawfully, in a way that infringes our rights or the rights of third parties, or misrepresent the Report's findings - for example by presenting a category rating as an overall verdict, a guarantee, or professional advice.

14. No reliance and assumption of risk

14.1 The Report is one input among many. You alone are responsible for your decisions, including whether to buy a property, at what price, and on what conditions. You must carry out your own due diligence and obtain independent professional advice.

14.2 You acknowledge and accept that: hazard exposure screening cannot predict events; a favourable rating (including "green" or "no material findings") does not guarantee that a hazard will not occur or that a property will not be damaged - for example by an earthquake, flood, wildfire, or storm; and the occurrence of such an event after your purchase does not by itself mean the Report was defective. You assume the risk of relying on the Report beyond its stated scope.

14.3 To the maximum extent permitted by law, you agree not to rely on the Report as the basis for any decision without independently verifying the matters that are out of scope (Section 4) or subject to data gaps (Section 5).

15. Disclaimers of warranty

15.1 For Consumers in the EU/EEA (including the Czech Republic): we supply the Report with the quality and conformity required by mandatory Czech and EU consumer law, which is not affected by this Section. Subject to that, and to the maximum extent permitted by law, we give no further warranties.

15.2 For all other Customers (including Customers in the United States): except as expressly stated in these Terms, and to the maximum extent permitted by law, the Report and the Website are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, title, and non-infringement. We do not warrant that the Report is error-free or that Public Data is accurate or complete.

16. Limitation of liability

16.1 Mandatory carve-outs: nothing in these Terms excludes or limits our liability where it may not lawfully be excluded or limited, including liability for harm caused to a person's natural rights (such as life and health) and liability for harm caused intentionally or by gross negligence. Nothing in these Terms limits a Consumer's non-waivable statutory rights.

16.2 Subject to Section 16.1, and to the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Report and these Terms is limited to the amount you actually paid for the relevant Report.

16.3 Subject to Section 16.1, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of property value, or loss arising from your reliance on the Report beyond its stated scope, or from the occurrence of any natural or other event.

16.4 You acknowledge that the price of the Report reflects this allocation of risk: a technically exhaustive, individually surveyed and professionally certified assessment of a property would be a different service at a substantially higher price. The price of the Report is agreed in reliance on this Section.

17. Indemnification

17.1 To the maximum extent permitted by law, and except where you are a Consumer protected by mandatory law that prevents this, you agree to indemnify us against third-party claims arising from your breach of these Terms, your unlawful use of the Report, or your redistribution or misrepresentation of the Report contrary to Sections 12 and 13.

18. Governing law and jurisdiction

18.1 These Terms and any contract concluded under them are governed by the law of the Czech Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

18.2 Consumer savings clause: if you are a Consumer habitually resident in the EU/EEA, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in, and may be sued only in, the courts of your country of habitual residence. For all other Customers, the courts of the Czech Republic have jurisdiction to the extent permitted by law.

19. Out-of-court dispute resolution

19.1 We aim to resolve complaints directly - please contact hi@filipmolcan.com first.

19.2 If you are a Consumer, the competent body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Štěpánská 796/44, 110 00 Prague 1, Czech Republic, coi.gov.cz. ČOI provides this procedure free of charge and proceedings can be conducted in Czech or English.

20. Changes to these Terms

20.1 We may update these Terms from time to time. The version in force when you place your order governs that order. Material changes are posted on the Website with a new effective date.

21. Severability

21.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in force, and the invalid provision is replaced by a valid one that comes closest to its intended economic and legal purpose - without reducing the mandatory protection of Consumers.
